1. Legal information

These Terms and Conditions of Use (hereinafter the "Terms") are published by Wegazul SARL, a limited liability company incorporated under Moroccan law, registered in Morocco, whose registered office is located at ℅ Office No. 2, 1st floor, Lot A/83, Assaka, Tikiouine, Agadir (hereinafter "Wegazul" or "Teefun").

Teefun is a mobile application for travelers and a web platform for professional partners. The corporate website is for information purposes only. Contact address: legal@teefun.ma

2. Purpose of the Terms

These Terms define the terms and conditions of access to and use of the Teefun platform, as well as the rights and obligations of users, partners and Wegazul.

3. Description of the services

Teefun is a digital platform providing:

• access to centralized content useful to travelers (weather, currency, maps, local information, useful numbers, recommended apps, personalized itineraries generated by algorithms and artificial intelligence);
• connection between travelers and local partners (activities, restaurants, cooperatives, tourism services);
• online booking and payment of certain activities and services offered by third-party partners.

Teefun acts exclusively as a technical and commercial intermediary and is in no case the provider, organizer, insurer or seller of the activities offered.

4. Access to the platform

Browsing features can be accessed without creating an account. Creating a user account is required for any booking, payment or interaction with partners.

5. User and partner accounts

Each user undertakes to provide accurate, up-to-date and complete information. A user may not hold both customer and supplier status.

Teefun reserves the right to suspend or delete any account in the event of a breach of these Terms, fraud, abusive behavior or unlawful content, without notice or compensation.

6. Content

6.1 Partner content

Partners remain the owners of the content they publish (text, photos, videos, prices). They grant Wegazul a worldwide, royalty-free, non-exclusive, transferable and assignable license, for the entire term of protection of the rights, for the purposes of display, exploitation, communication, marketing and advertising on any medium.

6.2 User content

Users remain the owners of their content (reviews, photos, videos, stories, comments), but grant Wegazul a worldwide, royalty-free, non-exclusive, transferable and assignable license permitting its exploitation, reproduction, distribution and use for commercial, marketing and promotional purposes.

7. Verification and moderation

Teefun reserves the right to verify, moderate, refuse or remove any content or partner that does not comply with these Terms, without any obligation to provide justification.

8. Liability

Teefun is not liable for:

• the quality, conformity or safety of the services offered by partners;
• accidents, personal injury or property damage occurring during activities;
• partners' compliance with legal, tax or insurance requirements.

Wegazul's liability is strictly limited to proven direct damages and, in any event, to the amount of the commissions received on the transaction concerned.

9. Payments and commissions

Payments are collected by Wegazul on behalf of the partners.

Teefun charges a commission on transactions carried out via the platform. The amount and terms of this commission may vary depending on the partners, the services offered and the contractual agreements in force.

Wegazul reserves the right to change its remuneration terms subject to prior notice to the partners concerned.

Payouts to partners are made monthly, provided there is no dispute, with the possibility of set-off in the event of cancellation, refund or penalty.

10. Cancellations and refunds

• Cancellation by the customer: possible up to 24 hours before the activity. After this deadline, no refund is due.
• Cancellation by the partner: full refund to the customer.
• Customer no-show: no refund.
• Partner no-show: refund to the customer and exclusion of the partner.

In the event of a dispute, Teefun decides at its sole discretion on the basis of the evidence provided. Its decision is final, subject to legal remedies.

11. Personal data and personalization

Teefun collects and processes data relating to interests, location, history and usage behavior in order to offer a personalized experience based on algorithms and artificial intelligence.

This processing is detailed in the Privacy Policy, accepted together with these Terms.

12. Sanctions

Teefun may suspend, limit or remove access to the platform, without notice, in the event of fraud, misuse, breach of these Terms or behavior harming the platform or its users.

13. Dispute resolution

Any dispute shall first be subject to an attempt at amicable settlement for a minimum period of thirty (30) days before any legal action.

Class actions are expressly excluded. Each user acts in an individual capacity.

14. Governing law and jurisdiction

These Terms are governed by Moroccan law. Any dispute falls under the exclusive jurisdiction of the courts of Agadir.

15. Final provisions

Wegazul reserves the right to amend these Terms at any time. The applicable version is the one in force on the date the platform is used. In the event of translation, only the French version is authoritative.
